[Spoilers] By S5 of BrBa, they knew BCS was likely, right? It's interesting (and ludicrous) that here, in the 5A premiere, we see Saul claim to have some kind of ethical code.

Perhaps they were trying to link Saul to the less mercenary Jimmy? Show a vestige of his old self? Here's dialogue from that ep:


WALT: "So you took it upon yourself to give away $622,000 of my money to a man who had been sleeping with my wife."

SAUL: "She's my client, same as you. Does this arrangement get a little tricky at times? Absolutely. But I try my best, you know, ethically, in my duty--"

WALT: "--Ethically? I'm sorry. I must be hearing things. Did you actually just use the word "ethically" in a sentence? You're not Clarence Darrow, Saul. You're a two-bit bus-bench lawyer. And you work for me."

SAUL: "Yeah, well, Clarence Darrow never had a client like you ask him for something like this. Okay? Yeah, I put my ass on the line for you."


Isn't that interesting? Even after all those years of heinous criminal activity, he is still deluding himself that he operates in an ethical manner. That's bonkers, of course. Walt is an asshole, but his incredulity is the correct response here. I wonder, then, if Saul still respects the law in some weird way, even if this isn't borne out by his actions in any way, and still has a part of himself that thinks of his brother's enormous regard for professionalism and ethics (again, this is not actually shown in his actions, since Saul is 100% a criminal). I think, even in the BrBa era, Saul still wants to think of himself as legitimate, even while he's acting illegitimately. It's an enduring wish to live up to his brother's golden standard.

Another thing: Walt specifically echoes Chuck's claims about Saul not being "a real lawyer." Walt is evil and Chuck is not, but there are similarities between them -- arrogance and genius -- and I wonder how much of that informs Saul's ebb and flow when it comes to his relationship with Walt (i.e., his appreciation and, at other times, his dislike of him).
