On its face, we know that Merkert was probably who he says he is and not involved nerfariously with the drugs in any way, but if you observe all of his character's parts and relationship with Gustavo, you see that he could have been a mole/plant in the DEA who was covering up the ground level business.
Even in season 3, how he keeps trying to send Hank to El Paso can be viewed as him seeing Hank getting "too close" to the bigger level of the business and about to make a break in the case so he wants him to move onto another case there in Texas.
And of course, his story about the sea bass in his back yard. Often times, it seems, corrupted officials don't resign until they can no longer hide their involvement or the smoke gets too thick to no longer deny the fire. When Gus went down, Merkert had to step down and take the fall.
Also, Merkert introduces Gus to Hank and it's assumed Gus had to be close with Merkert to get in close with the DEA since Merkert was the one in charge.
Merkert would be an excellent mole for Gus' operation. He could thwart any DEA leads and investigations that get too close or he could misdirect his investigators if need be while allowing Gus and the cartel to operate.
